1. 当事人、适用范围与定义 | Parties, scope and definitions
1.1 “工作室”指预约确认表列明的法定服务提供方，“客户”指签约付款方。Lulu、Aria 是团队成员称呼，不替代法定合同主体。
“Studio” means the legal supplier named in the Booking Schedule. “Client” means the contracting purchaser. Lulu and Aria are team-member names, not substitutes for the legal contracting party.
1.2 本模板适用于提前以网站、邮件或其他非现场方式成立的私人写真与包车摄影订单。婚礼、收费活动报道、企业广告、互勉、独立化妆或网站制作服务应另订协议。现场首次签约或新增独立服务须先核实适用直接销售要求；在现场用手机签字不自动改变交易性质。
This template covers private portraits and photo days contracted in advance online, by email or otherwise not in person. Weddings, paid events, corporate campaigns, trade-for-portfolio, standalone beauty and website services require separate terms. First-time in-person contracts or new standalone services require prior direct-sales review; signing on a phone while together does not itself change the transaction type.
1.3 “工作日”指温哥华当地周一至周五，BC 法定假日除外；“日”或“自然日”包含周末。每次预约的时间以 America/Vancouver 时区为准。
“Business day” means Monday to Friday in Vancouver, excluding BC statutory holidays. “Day” or “calendar day” includes weekends. Booking times use the America/Vancouver time zone.
1.4 “书面”包括可保存的电子邮件、双方认可的消息或电子签名记录。核心范围、费用、期限及人员变更须明确同意；沉默、咨询或单纯浏览页面不构成购买或授权。
“Written” includes retainable email, mutually recognized messages and e-signature records. Material changes to scope, charges, deadlines or personnel require express agreement; silence, an inquiry or page viewing is not a purchase or consent.
2. 预约成立、文件与未成年客户 | Booking formation, records and minors
2.1 咨询不锁定档期，也不要求付款或宣传授权。工作室核实档期、履约能力及必要运输资格后提供填妥的确认表和全部条款；双方明确接受且收到约定预约款后发送正式确认。误收未确认款项应及时全额退回。该工作流程不改变法律对合同实际成立时间的认定。
An inquiry does not reserve a date or require payment or publicity permission. After verifying availability, capacity and any required transport authority, the Studio supplies the completed schedule and full terms, then confirms after mutual express acceptance and the agreed initial payment. Money mistakenly taken for an unconfirmed booking is promptly refunded in full. This workflow does not override the legal determination of when a contract actually forms.
2.2 付款前客户可查看、保存和打印全部条款、纠正错误并明确接受或拒绝。合同成立后，工作室无不必要延迟地向指定邮箱发送已接受的完整版本、附表及付款记录，通常于 1 个工作日内，且不得超过适用法定期限。不得只发送可随时更改的网页链接；客户可索取可保存副本。
Before payment the Client may review, retain and print all terms, correct errors and expressly accept or decline. Once formed, the Studio sends the accepted complete version, schedules and payment record to the designated email without unnecessary delay, ordinarily within 1 business day and never beyond the applicable statutory deadline. A changeable web link alone is insufficient; a retainable copy is available on request.
2.3 未满 19 岁的签约或拍摄安排，须由适当法定监护人作为成人客户签约并确认陪同安排。每位有能力自行同意的参与者自行决定是否接受拍摄和宣传；付款方不能自动代表其他成人放弃权利。
For a booking or subject under 19, an appropriate legal guardian must contract as the adult Client and confirm supervision arrangements. Each participant capable of consent decides about photography and publicity. The purchaser cannot automatically waive another adult’s rights.
3. 套餐内容与数量边界 | Package inclusions and quantity limits
3.1 C$99 与 C$299 共用一次最多 2 小时写真及动作引导。C$99 包含 3 张精修；C$299 包含 10 张精修及全部合格 JPEG。默认 1 名拍摄对象；经确认可加至最多 3 人，额外对象 C$50／人，精修总数不增加。
C$99 and C$299 share one portrait session of up to 2 hours with posing guidance. C$99 includes 3 retouched images; C$299 includes 10 retouched images and all eligible JPEGs. One subject is standard; by agreement up to three are permitted at C$50 per additional subject, without increasing the retouch count.
3.2 C$500 包含一位摄影师兼司机、确认范围内的合法用车、拍摄引导、10 张精修及全部合格 JPEG。C$500 Private Photo Day 包含一位摄影师兼司机、私人用车及最多 8 小时服务。C$100 定金抵扣总价，C$400 余款在行程结束前付清；经确认加时 C$40／小时，按实际分钟折算。C$899 包含 Lulu 与 Aria 双人团队、确认范围内的合法用车、拍摄环节双摄、跟妆、25 张精修及全部合格 JPEG；初妆和发型范围必须在确认表填写。
C$500 includes one photographer/driver, lawful transport within the confirmed scope, posing guidance, 10 retouched images and all eligible JPEGs. C$899 includes the two-person team of Lulu and Aria, lawful transport within scope, dual-camera work during photography, touch-ups, 25 retouched images and all eligible JPEGs. Initial makeup and hairstyling must be specified in the schedule.
3.3 两档包车均含最多 8 小时连续服务，默认最多 2 名客户参与；车辆座位、行李、儿童座椅及额外人数须提前核实。除确认表另有明确约定，跟妆服务面向 1 名指定对象。不得超载。
Both photo days include up to 8 continuous service hours and, by default, up to two client participants. Seats, luggage, child restraints and any additional participants must be verified beforehand. Unless expressly varied in the schedule, touch-ups cover one named recipient. Overloading is not permitted.
3.4 “双摄”指拍摄环节的双人分工及不同角度记录，不承诺车辆行驶、化妆、转场或休息期间同时连续拍摄；不自动包含视频、无人机或短片剪辑。
“Dual-camera” means coordinated team coverage and different angles during photographic portions, not uninterrupted simultaneous shooting while driving, applying makeup, transferring or resting. Video, drone work and edited films are not automatically included.
3.5 精修数量按整单计算，不按人数、摄影师数量、造型数或小时数倍增。C$99 额外精修 C$40／张；其他三档 C$20／张，仅适用于本次合格照片的标准精修。复杂处理另报价，未经确认不收费。
Retouch counts apply per booking, not per person, photographer, look or hour. Extra standard retouches from this session’s eligible images are C$40 each under C$99 and C$20 each under the other three plans. Complex work requires a separate accepted quote.
3.6 C$299 包含 1 个 5×7 英寸摆台相框；C$899 包含 1 个 8×10 英寸及 1 个 5×7 英寸摆台相框，款式和交付方式在确认表写明；C$99／C$500 默认不含实体产品。上述实物是套餐内容，不因称为“赠品”而消失，也不保证任何特定税务结果。邮寄、特别材料及额外产品须另行明确购买。
C$299 includes one 5×7-inch tabletop framed print; C$899 includes one 8×10-inch and one 5×7-inch tabletop framed print, with style and delivery specified in the schedule. C$99/C$500 have no default physical products. Included items remain package obligations even if described as gifts; no particular tax result is promised. Shipping, special materials and additional products require express purchase.
4. 付款、定金及后续购买 | Payments, deposits and optional purchases
4.1 写真预约支付 C$50，抵扣最终所选 C$99 或 C$299 套餐。客户看水印预览后可选择不购买；工作室已按约完成拍摄和预览准备时，该 C$50 作为已提供服务费用保留，不收 C$49／C$249 余款，也不交付无水印照片或实体产品。自身履约问题及法定退款不受此限制。
The C$50 portrait booking payment credits the chosen C$99 or C$299 collection. The Client may decline a collection after viewing proofs. If the Studio properly completed the session and proofs, C$50 is retained for those services, with no C$49/C$249 balance and no unwatermarked files or physical products. Studio failures and statutory refunds remain protected.
4.2 写真客户另行购买的初妆、额外对象等服务，不属于“看预览后决定”的照片收藏价；金额、付款时点须提前单列。不得宣称含这些加项的订单“最多只损失 C$50”。
Separately purchased portrait extras, such as initial makeup or extra subjects, are not part of the optional proof-based collection purchase. Their prices and payment timing must be separately disclosed. An order containing those extras must not be advertised as having a maximum exposure of C$50.
4.3 C$500 与 C$899 均支付 C$100 定金抵扣总价，基础余款分别 C$400／C$799，于当天约定行程结束前结清。工作室在结束前提供明细账单，税费、获准加时和加购另列；不以客户看完后期成片或表示主观满意为付款前提。
Both C$500 and C$899 require a C$100 credited deposit. Base balances of C$400/C$799 are due before the booked outing ends. The Studio provides an itemized bill beforehand, separately showing taxes and approved overtime/extras. Payment is not conditional on reviewing later retouched files or expressing subjective satisfaction.
4.4 写真收藏须另行明确选定并支付余款后才安排相应精修和无水印交付。不得因未回复自动升级、自动扣款，或仅因打开预览而视为购买。包车客户付款后不需再次购买套餐内照片。
A portrait collection requires express selection and balance payment before its retouching and unwatermarked delivery. There is no automatic upgrade, charge or purchase merely from silence or opening proofs. Photo-day clients need not repurchase included images after paying the agreed package.
4.5 如有真实争议，双方记录具体争议项目；无争议款项仍按期支付，但不限制客户依法享有的扣款、拒付或退款权利。工作室可对合法到期而未付的影像项目暂缓交付，不得扣押客户、证件或行李，或在不安全地点中断送达。
Genuine disputed items are documented. Undisputed sums remain payable, without limiting lawful withholding, chargeback or refund rights. The Studio may pause delivery of image items lawfully due but unpaid; it must not detain a person, documents or luggage or terminate transport at an unsafe location.
4.6 未另行签署合法书面融资安排时，不收逾期利息、复利或惩罚性催收费。退款按法定期限；本协议自愿退款如无法律另定，最迟在确认应退款后 15 个自然日内办理，并向客户提供记录。
Absent a separate lawful written financing arrangement, there is no late-payment interest, compounding or punitive collection charge. Statutory refund deadlines apply. Otherwise, contractual refunds are processed within 15 calendar days after entitlement is established, with a record supplied to the Client.
4.7 预约款为价款抵扣，不因称为“定金”就当然不退，也不自动等于取消责任上限。GST／PST 等按适用法律及实际登记义务处理，并在签约或追加购买前列明税种、税率、计税基础和含税总额。已付款及已收税额正确抵扣，不重复征收；不能以事后内部税务重新分类为由任意提高已确认总价，但法律强制要求除外。
4.7 Initial payments are price credits, not automatically non-refundable or cancellation caps merely because they are called deposits. Applicable GST/PST and registration obligations are addressed with the tax, rate, taxable base and inclusive total disclosed before contracting or additional purchase. Payments and taxes already collected are properly credited without duplication. Later internal tax reclassification does not permit arbitrary increases to an agreed total, subject to mandatory law.
5. 计时、迟到与加时 | Service clock, lateness and additional time
5.1 服务从确认表约定开始时间计算，不因客户迟到、未化妆完毕、换衣、等待同行人员而自动顺延。服务中约定的化妆、转场、停车、等候及合理休息均计入连续时长，不承诺 8 小时纯拍摄。团队自行往返首末服务地点的通勤不另计入。
Time runs from the agreed start, not a later time caused by Client lateness, unreadiness, wardrobe changes or waiting for companions. Agreed beauty work, transfers, parking, waiting and reasonable breaks count within the continuous block, not eight hours of camera-only work. The team’s own commute to the first and from the final service point is not added.
5.2 工作室迟到、准备不足、车辆电量不足或自身安排不当造成实际服务时间损失时，应及时告知并免费补足同等受影响服务时间。补时不占用客户另购加时，不收加时费；未经客户同意不能强迫其延迟返程或接受另一天。
If Studio lateness, unreadiness, inadequate vehicle charge or its own poor scheduling causes actual service time loss, it promptly informs the Client and restores equivalent affected service time free. Restoration is not billed as overtime or taken from separately purchased time. A later return or replacement date cannot be imposed without consent.
5.3 若双方无法安排合理补时：整项包车服务损失的分钟数，最低按折后基础套餐价 × 未补足分钟数 ÷ 480 减价或退款；写真按 C$50 预约服务费 × 未补足分钟数 ÷ 120 调整。若确认的服务块短于上述时长，分母使用实际约定分钟数。部分团队或项目缺失按实际受影响价值处理，并作相应税额调整。该公式是最低合同补救，不是加时单价或法定赔偿上限；同一损失的重复计算依第 12.6 条处理。
If reasonable restoration cannot be arranged, loss of the entire photo-day service receives at least the discounted base package price × unrecovered minutes ÷ 480 as a price reduction/refund. Portraits use C$50 × unrecovered minutes ÷ 120. If a shorter service block was agreed, use its actual agreed minutes as the denominator. A missing individual function is assessed by its affected value, with the corresponding tax adjustment. This is minimum contractual relief, not the overtime rate or a statutory damages cap; section 12.6 addresses duplicate recovery for the same loss.
5.4 不承诺四倍时间或最低一小时的惩罚性补偿。因工作室造成关键且不可替代内容落空时，不能仅以延长时间声称已完全补救，应依第 12 条处理。
There is no fourfold or one-hour-minimum penalty. If a Studio failure defeats an essential, irreplaceable agreed element, merely extending time is not automatically a complete remedy; section 12 applies.
5.5 C$500 加时 C$40／小时，C$899 加时 C$65／小时。按双方确认的实际额外分钟数折算，金额四舍五入至分，不设最低一小时。加时前告知预计费用并获明确同意；确认结束时间应包含约定最终送达。没有同意，不主动安排必然超时的新地点。
Overtime is C$40/hour for C$500 and C$65/hour for C$899, prorated by agreed actual extra minutes and rounded to cents, without a one-hour minimum. The expected charge requires express advance approval. The confirmed end includes agreed final drop-off. Without consent the Studio does not add stops that necessarily create overtime.
5.6 正常道路转场属于服务时长，但未获批准的超时不自动收费；工作室须合理规划、提醒时间并提供结束或加时选择。不可安全即时结束的路段先完成安全送达，再按已约定规则结算，不强迫付款或危险下车。加时不自动增加精修、造型或团队人数。
Ordinary transit counts as service time, but unapproved overruns are not automatically billable. The Studio plans reasonably, monitors timing and offers an end-or-extend choice. Where immediate termination would be unsafe, safe transport comes first and only agreed charging rules apply. Extra time does not automatically increase retouches, looks or team size.
6. 行程、附加费用与第三方 | Itinerary, additional costs and third parties
6.1 只提供确认表内的区域、路线及服务。停车、场地、门票、轮渡、餐饮、邮寄和住宿等如未明确包含，则须列明由谁支付，并在发生前取得费用或上限批准。已能确定的必需费用应计入预先报价，不得作为隐藏加收。小费完全自愿。
Only the scheduled areas, route and services are included. Parking, venues, admission, ferries, meals, shipping and lodging must identify the payer and require approval of a cost or cap if not included. Known mandatory costs belong in the advance quote, not hidden surcharges. Tips are entirely voluntary.
6.2 拍摄许可和场地预约由确认表指定的一方负责；工作室须告知已知限制，并合理核查自己推荐地点。不得擅入、妨碍交通或无依据保证进入受限地点。优先争取的画面并非逐张保证，但双方明确接受的核心服务不得仅凭“尽力”措辞被降级。客户自行订购外部项目按第三方条款处理，不免除工作室自身责任。
The party named in the schedule obtains venue bookings and permits; the Studio discloses known restrictions and reasonably checks recommended locations. No trespass, traffic obstruction or unsupported access guarantee is permitted. Requested priority images are not guaranteed frame by frame, but expressly accepted essential services cannot be downgraded by a general best-efforts clause. Client-booked external services follow their own terms without excusing Studio fault.
6.3 C$500／C$899 不代表销售或代订住宿、航班、景点票或第三方旅行套餐；如需此类服务，先核实适用许可并另行明确。不得通过将交通称为“免费赠送”规避应适用的经营、保险或运价规则。
C$500/C$899 do not automatically include selling or arranging accommodation, flights, attraction tickets or third-party travel packages. Such services require prior licensing review and express separate arrangements. Calling transport “complimentary” does not avoid applicable operating, insurance or rate rules.
7. 美妆、身体接触、交通与安全 | Beauty, personal boundaries, transport and safety
7.1 客户提前说明对安排有实际影响的过敏、皮肤敏感、行动辅助或儿童座椅需求，仅提供必要信息。美妆前说明相关产品和方法，工作室使用合理卫生措施；客户出现不适可立即要求停止。披露或同意服务不构成对疏忽、伤害或法定权利的放弃。
Clients disclose only necessary allergy, skin-sensitivity, accessibility or child-restraint needs affecting the service. Relevant products/methods are discussed before beauty work and reasonable hygiene is used. A participant may stop on discomfort. Disclosure or consent does not waive negligence, injury or statutory rights.
7.2 调整头发、衣服或姿势前先征求同意；不要求裸露或危险动作。衣服、配饰、美瞳及个人必需品由客户准备，除非确认表明确提供。客户可带合理陪同，须提前确认场地与车辆容量。
Permission is sought before touching hair, clothing or positioning a subject. No nudity or unsafe pose is required. Clients bring clothing, accessories, contacts and personal necessities unless expressly supplied. Reasonable companions may attend subject to advance venue and vehicle-capacity planning.
7.3 工作室只安排具备适当资格、许可和保险的运输服务，并负责核实，而不是让客户放弃核查。所有乘员使用安全带及适用儿童约束设备；未准备好不得发车。司机行驶时不拍摄、不操作拍摄设备，不为赶时间违法驾驶。
The Studio verifies and arranges only transport with appropriate driver qualifications, licences and insurance; it does not shift that verification to the Client through a waiver. All occupants use seat belts and required child restraints before departure. Drivers do not photograph or operate camera equipment while driving and do not drive unlawfully to recover time.
7.4 危险、严重骚扰、暴力、违法要求或明显无法安全参与时，工作室可先暂停，情况允许时说明原因并给出纠正机会。普通投诉或提出修改不是骚扰。必须终止时优先安全和适当交接；退款按已提供价值、合法损失及双方过错合理结算，不自动没收全款。
The Studio may pause for danger, serious harassment, violence, unlawful requests or clear inability to participate safely, explaining and allowing correction where appropriate. Ordinary complaints or revision requests are not harassment. Termination prioritizes safety and appropriate handover; settlement reflects delivered value, lawful loss and responsibility, not automatic forfeiture of the full price.
7.5 客户对其故意或过失造成、可证明的财物损坏依法负责，正常磨损不收费；异常清洁或维修须提供证据和合理实际费用，不设置任意罚金。随身物品由各自合理照管，不排除工作室自身过错责任。
Clients remain legally responsible for proven property damage caused intentionally or negligently, not ordinary wear. Exceptional cleaning/repair requires evidence and reasonable actual costs, not arbitrary penalties. Each party takes reasonable care of belongings without excluding Studio fault.
8. 天气与不可控事件 | Weather and uncontrollable events
8.1 临近拍摄时共同评估天气、空气质量、路况及场地限制。若不安全、依法不能进行，或无法提供提前明确的重要服务，优先无改期费改期或双方同意替代；不得单方面把户外改室内或减少服务。仅阴天但仍可完成约定服务，不当然视为无法履行。
Near the session, the parties review weather, air quality, roads and venue limits. Unsafe, unlawful or materially impossible agreed services are rescheduled without a rescheduling fee or replaced by mutual agreement. Outdoor work cannot unilaterally become indoor or reduced service. Overcast conditions alone do not establish inability to perform.
8.2 因上述原因无法找到双方合理可接受的新日期，客户可取消未提供部分并获相应退款；全部服务尚未提供时退还定金。经客户事先明确批准且确实无法退回的独立第三方支出须提供凭据，且仅在法律允许时扣除。
If no reasonably acceptable replacement date is available, the Client may cancel the unperformed portion for a corresponding refund; a wholly unperformed booking includes refund of the deposit. Any deduction for separately pre-approved, genuinely nonrecoverable third-party costs requires evidence and must be lawful.
8.3 突发灾害、政府限制或异常道路封闭等应及时通知、尽量减轻影响，并按未完成部分合理退款或改期。普通堵车、忘带设备、电量不足或双重订档不得自动称为不可抗力。不可控事件也不赋予工作室保留未赚取费用的无限权利。
Unexpected disasters, restrictions or exceptional closures require prompt notice and reasonable mitigation, with rescheduling or fair refund for unperformed services. Ordinary traffic, forgotten equipment, insufficient charge or double-booking are not automatically force majeure. An uncontrollable event does not confer an unlimited right to retain unearned fees.
9. 普通取消、改期与爽约 | Ordinary cancellation, rescheduling and no-shows
9.1 本条只适用于客户自愿改变计划。法定取消、工作室违约及第 8 条优先，不适用本条普通取消费。通知可用能证明内容及发送时间的方式发至确认表联系人，不要求指定表格或工作室同意。以下小时数按温哥华时间，从有效通知时间至原约定开始时间计算；168 小时等于 7 个连续自然日。
This section applies only to voluntary changes of plan. Statutory cancellation, Studio breach and section 8 take priority and are not subject to these ordinary charges. Notice may use a provable method to the scheduled contact, without a special form or Studio approval. Hours are measured in Vancouver time from effective notice to the original start; 168 hours is 7 consecutive calendar days.
9.2 写真提前至少 48 小时、包车提前至少 168 小时，可免费改期一次；原预约款抵扣双方明确同意的新日期，目标在原日期后 90 日内完成。没有可合理接受的新日期时按原通知时间的取消规则结算，不自动变成失效代金券。晚于上述门槛的改期按第 9.3／9.4 条评估原档期实际净损失；工作室可以减免，但须书面记录。仅同意改期不构成承诺新增服务或额外收费。
Portraits with at least 48 hours’ notice and photo days with at least 168 hours’ notice permit one free reschedule, crediting payment to an expressly agreed date targeted within 90 days. If no reasonable date is available, settle under the cancellation rule at the original notice time, not an expiring voucher. Later rescheduling is assessed for actual net loss on the original slot under sections 9.3/9.4; any waiver is recorded. Agreement to reschedule alone does not purchase extra service or authorize added charges.
9.3 写真未开始前：至少 48 小时通知，工作室不收内部取消费；不足 48 小时或爽约，只能收取可合理证明、经减损后的实际净损失，且以 C$50 为上限。尚未购买的 C$99／C$299 收藏余款不因取消而到期。独立加项在开始前取消，除补充订单另有清楚且合法约定外，其工作室内部损失也计入该 C$50 上限；已独立完成的服务及第三方费用依第 9.4 条结算。
Before a portrait session begins, there is no internal cancellation charge on at least 48 hours’ notice. Inside 48 hours or for a no-show, only reasonably substantiated actual net loss after mitigation is chargeable, capped at C$50. Unpurchased C$99/C$299 collection balances do not become due on cancellation. Unless a supplemental order clearly and lawfully provides otherwise, internal loss on cancelled, unstarted extras also falls within that C$50 cap. Independently completed services and third-party expenses are settled under section 9.4.
9.4 包车未开始前：提前至少 168 小时，内部取消费为零；提前至少 72 小时但不足 168 小时，上限为折后基础套餐价的 25%；不足 72 小时或爽约，上限为折后基础套餐价的 50%。实际应收额为上述上限与可合理证明的实际净损失中的较低者，不是自动罚金或固定违约金。基础价不含税、未获批准的加时及另列加项。
Before a photo day begins, the internal cancellation ceiling is zero on at least 168 hours’ notice, 25% of the discounted base package price on at least 72 but under 168 hours, and 50% inside 72 hours or for a no-show. The charge is the lesser of that ceiling and reasonably substantiated actual net loss, not an automatic penalty or fixed damages sum. Base price excludes tax, unapproved overtime and separately itemized extras.
9.4(a) 实际净损失只包括本单取消直接造成、法律允许回收且有合理证据的损失。应扣除节省的拍摄、交通、修图、打印等成本，以及替代预约的净回收；一般广告、日常管理成本和假定的整单收入不是自动损失。相同成本不得既计入已提供服务又计入取消费。已知回收变化后应重新核算并退还多收部分。
9.4(a) Actual net loss includes only legally recoverable loss directly caused by this cancellation and supported by reasonable evidence. Deduct saved shooting, transport, editing, printing and other costs, plus net recovery from replacement bookings. Ordinary marketing, overhead and assumed gross booking revenue are not automatic loss. Do not charge the same cost as both performed service and cancellation loss. Recalculate and refund overcollection when later recovery becomes known.
9.4(b) 另列加项的未履行部分，不因取消自动收全价；未有事前明确合法约定时，其内部损失计入同一上限。确已独立完成的加项仅按事前接受的价格和实际提供价值结算。第三方费用仅在事前单独披露用途、金额或上限及取消后负担，并由客户明确同意、实际不可回收及法律允许时另计；须提供凭据，不与基础套餐内成本重复收取。
9.4(b) Unperformed extras are not automatically payable in full. Without a clear lawful advance agreement, their internal loss is within the same ceiling. Independently completed extras are settled only at the accepted price and actual delivered value. Separate third-party expense is payable only where its purpose, amount/cap and cancellation allocation were individually disclosed and accepted in advance, it is actually nonrecoverable and recovery is lawful. Provide evidence and do not duplicate costs already included in the base package.
9.4(c) 未打折例：C$500 的 25%／50% 上限为 C$125／C$250；C$899 为 C$224.75／C$449.50。已付 C$100 全部抵扣合法应付额，不是另加一笔。税务及第三方成本按实际法律和上述规则另核实。工作室提供损失明细及抵扣账单；有依据且无争议的不足额于账单后 14 个自然日内支付，争议按第 4.5、16 条处理，不自动扣卡。
9.4(c) At undiscounted prices, the 25%/50% ceilings are C$125/C$250 for C$500 and C$224.75/C$449.50 for C$899. The C$100 paid is fully credited against the lawful amount, not added again. Tax treatment and third-party expenses are separately verified under law and the above rules. The Studio supplies a loss statement and credit calculation. Substantiated undisputed shortfalls are payable within 14 calendar days of billing; disputes follow sections 4.5 and 16, without an automatic card charge.
9.4(d) 结算应同时列明已付金额、合法应付取消费／已提供服务／第三方费用及适用税额。已付超过合法应付的余额按第 4.6 条退还；零内部取消费并不授权没收预约款。依法须全额或更早退款的，优先按法定规则执行。
9.4(d) Settlement identifies amounts paid, lawful cancellation charges, performed services, third-party expenses and applicable tax. Payments exceeding the lawful amount are returned under section 4.6; a zero internal cancellation charge does not permit deposit forfeiture. A statutory requirement for a full or earlier refund takes priority.
9.5 客户迟到时工作室尝试联系；写真超过 30 分钟、包车超过 60 分钟完全无法联系，且至少两次合理联系无回应，可书面通知按爽约处理。客户能联系且希望在剩余时段继续的，优先在原范围内提供可行服务，不因迟到自动加价。
The Studio attempts contact if the Client is late. After 30 minutes for portraits or 60 minutes for photo days with no contact and at least two reasonable unanswered attempts, it may give written no-show notice. If contact is established and the Client wishes to continue, feasible service within the remaining original block is preferred, without an automatic lateness fee.
9.6 服务已正常开始，工作室按约保持可用而客户单纯自行提前结束，不按未使用时间自动减价。因实际服务问题、安全事件或依法取消而结束，则按相关条款处理，不套用此规则。
Once service properly starts and the Studio remains available as agreed, the Client’s purely voluntary early departure does not automatically reduce a reserved-block price. Ending because of genuine performance issues, safety events or legal cancellation is assessed under the relevant provisions instead.
9.7 工作室无法到场或核心团队成员无法履约时，应及时通知。替代人员须客户同意且不得降低范围；客户可选择适当替代、改期或取消未完成服务并退款。C$899 不得未经同意变为单人服务；如同意改成 C$500，应明确退款或减少 C$399 基础差额及相应税额。
If the Studio or a core team member cannot perform, it promptly informs the Client. Substitution requires consent without reducing scope; the Client may choose a suitable substitute, rescheduling or cancellation/refund of unperformed services. C$899 may not become solo coverage without consent; an agreed change to C$500 identifies the C$399 base reduction/refund and tax adjustment.
10. 选片、文件标准与交付期限 | Selection, file standards and deadlines
10.1 合格 JPEG 是经合理筛选、曝光白平衡和整体调色的可交付照片，排除测试、技术失败和无意义重复；不等于所有快门文件，也不等于每张精修。最低交付数量在附表 A 写明；精修片若来自同一原片，不作为额外不同照片累计。达到最低数后仍须交付套餐承诺的全部合格 JPEG，不能为封顶而任意删减。未达到约定最低或核心质量标准时按第 12 条处理，不能用模糊的“艺术筛选”免责。
Eligible JPEGs are reasonably curated images with exposure, white-balance and overall colour finishing, excluding tests, technical failures and meaningless duplicates. They are not every shutter frame or all individually retouched. Schedule A states the minimum; a retouched version of the same source is not an additional distinct image. Reaching the minimum does not cap the promised full eligible set or justify arbitrary culling. A minimum/essential-quality shortfall is addressed under section 12, not excused by vague artistic selection.
10.2 精修包括约定程度的肤色、暂时性瑕疵、自然肤质、局部明暗和适度形态调整；显著改变身份特征、换脸、换背景、移除复杂人群、大幅服装或身体重构不默认包含。不会未经明确要求进行实质身份或体形改变。
Retouching includes agreed skin tone, temporary blemishes, natural texture, local tonal work and modest shaping. Material identity changes, face swaps, background replacement, complex crowd removal and major clothing/body reconstruction are not standard. Material identity or body-shape changes require explicit instructions.
10.3 无水印成片使用高分辨率 sRGB JPEG，通常短边不少于 3000 像素；特殊裁切不足时应先说明并得到认可。不提供 RAW、未筛选片、项目文件、分层文件或软件预设，除非另行购买。不得以简单更改 DPI 标签冒充更高像素交付。
Unwatermarked files are high-resolution sRGB JPEGs, normally at least 3000 pixels on the short edge. A smaller special crop must be disclosed and accepted. RAW files, unculled frames, project/layer files and presets are excluded unless separately purchased. Changing a DPI label alone is not higher-resolution delivery.
10.4 人像水印预览于拍摄后 5 个工作日内提供；包车于拍摄后 7 个工作日内提供选片预览，已结清款项时同步交付合格 JPEG。各项实际供给日期在确认表写明，预览可用不代表客户放弃质量反馈。
Portrait proofs are provided within 5 business days of shooting. Photo-day selection proofs are provided within 7 business days, with eligible JPEGs delivered at the same time if payment is complete. Actual supply dates are recorded in the schedule. Access to proofs is not a waiver of quality feedback.
10.5 客户应在可用预览及选片通知提供后 14 个自然日内按编号选片。已付款客户迟选不自动丧失交付；仅由其迟延直接导致的制作延误可合理顺延，工作室书面说明影响及新的最迟日期，不借此推迟其他已能完成的交付。未购买的写真客户不回复不构成购买，工作室不得自行收取收藏余款。
The Client should select file numbers within 14 calendar days after usable proofs and the selection notice are supplied. A paying client does not automatically forfeit delivery through delay. Only production delay directly caused by that delay may reasonably extend the affected deadline; the Studio states the effect and revised latest date in writing without delaying other ready deliverables. Silence by an unpurchased portrait client is not a purchase and does not authorize a collection balance.
10.5(a) 对已购买且需要选片的项目，工作室在第 14 日前后发送提醒；至第 30 日仍未完成时，发送最终选片通知并给予至少 15 个自然日。客户只有在附表 D 单独明确勾选授权后，工作室才可在通知期限届满且不早于预览／已购买选片通知提供后第 45 日代选，按已确认风格完成套餐内精修；该通知日取可用预览与购买均已具备的较晚日期。
10.5(a) For a purchased item requiring selection, the Studio sends a reminder around day 14 and, if still incomplete by day 30, a final notice allowing at least 15 calendar days. Only a separate express election in Schedule D authorizes Studio selection after that notice period and no earlier than day 45 after the paid selection notice, followed by included retouches in the agreed style. That notice date is no earlier than both usable proofs and purchase being in place.
10.5(b) 代选仅适用于客户已经购买的精修，不授权新增收费、宣传或未经批准的印刷。客户可在代选开始前书面撤回代选；代选开始后另换照片按新增工作先报价，工作室错误仍免费纠正。代选后的精修最迟日期须在授权／最终通知中写明，并遵守第 10.6 条时长；第 11 条的一轮偏好修改仍保留。
10.5(b) Studio selection covers only retouches already purchased; it authorizes no extra charge, publicity or unapproved printing. It may be revoked in writing before selection begins. Later image substitution is separately quoted new work, but Studio error remains a free correction. The authorization/final notice states the latest retouch date and respects section 10.6 timing; the section 11 preference round remains available.
10.5(c) 未获代选授权且客户长期无回应时，订单转为待客户指示；第 90 日前后可书面提出延期、授权代选或按未完成部分价值协商结案退款。未达成合法结案前，不视为已完成、不没收未履行部分价款，也不按普通存档期删除完成已付交付所必需的文件。除新协议明确约定外，不自动收取保管或重开订单费用。未购买收藏的写真不存在未购买精修的交付义务。
10.5(c) Without selection authority and with prolonged nonresponse, mark the order awaiting Client instructions. Around day 90, propose an extension, authorized selection or consensual closure/refund reflecting unperformed value. Before lawful closure, do not deem completion, forfeit unearned amounts or routinely delete files necessary for paid delivery. No storage or reactivation fee arises without an expressly accepted new agreement. An unpurchased portrait collection creates no duty to supply its unpurchased retouches.
10.6 收到完整选片、已到期款项和明确修图要求后，人像精修于 7 个工作日内、包车精修于 10 个工作日内交付。可先用套餐内一张确认风格；该张计入总数，不能凭工作室自行增加的确认步骤无限延迟。客户新增要求导致的时间变化须书面说明并确认。
After complete selections, due payment and clear editing instructions, portrait retouches are due within 7 business days and photo-day retouches within 10. One included image may be used for style confirmation and counts toward the total. Studio-created approval steps cannot extend deadlines indefinitely. Timing changes caused by new requests require written explanation and agreement.
10.7 实体产品按客户确认的最终照片制作，默认于确认后 10 个工作日内完成制作或寄出；确切规格、交付地点和日期以确认表为准。显示器与印刷可能有正常色差，但制作错误、破损或与确认规格不符的由工作室合理纠正。
Physical products are made from Client-approved final images and normally ready or dispatched within 10 business days of approval, with exact specifications, destination and date in the schedule. Normal screen-to-print variation is possible, but production errors, damage or nonconformity are appropriately corrected by the Studio.
10.8 数字交付通过受访问保护的下载链接或双方确认方式进行，需要可打开 JPEG／ZIP 的设备和网络。链接默认保留 60 日并提醒下载。链接到期不等于免除尚未完成的交付；存档期内可免费补发一次现有文件。
Digital delivery uses an access-protected link or agreed method and requires internet access and a device able to open JPEG/ZIP files. Links normally remain available for 60 days with a download reminder. Expiry does not cancel an outstanding delivery obligation; existing files may be re-sent once free within the archive period.
11. 修改范围与防止无限返工 | Revisions and limits on repeated rework
11.1 套餐内精修交付后 7 个自然日内，客户可提交一份按编号整理的集中偏好修改意见，包含一轮原约定风格内的颜色、肤色、磨皮和适度修饰调整。工作室在收到清晰汇总后 7 个工作日内交回，复杂情况先协商明确日期。
Within 7 calendar days after retouched delivery, the Client may submit one consolidated, numbered preference-revision request. One round of colour, skin-tone, texture and modest retouch adjustments within the agreed style is included, returned within 7 business days of clear consolidated instructions unless a definite alternative date is agreed for complexity.
11.2 一轮按同批精修的一份汇总计算，不按每条聊天消息计次；若客户持续补充，应先确认何时视为汇总完成再开始。不得将“我要自然一点”之类合理说明拆成数次收费。
A round means one consolidated request for that batch, not a fee per message. If comments are still being added, agree when the list is complete before starting. Reasonable explanations such as “more natural” are not artificially split into chargeable rounds.
11.3 工作室遗漏已确认要求、出现修图痕迹、导出错误或未按约完成，须免费纠正，不消耗偏好修改次数，也不因七天过后当然免责。纠错不等于客户可无限改变原要求。
Missed agreed instructions, editing artifacts, export errors and failure to deliver the promised edit are corrected free, do not use the preference round and are not automatically excused after seven days. Correction does not permit endless changes to the original instructions.
11.4 新风格、换选已开修照片、增加精修张数、复杂合成及额外偏好轮次属于新工作；工作室先说明范围、价格和时间，客户明确同意后才做。客户可拒绝，不影响其已购买的合格交付。任何一方无需接受新增创作委托。
A new style, switching an image after retouching has begun, additional images, complex composites and further preference rounds are new work. Scope, price and timing require prior express agreement. Declining does not affect already purchased compliant deliverables. Neither party is obliged to accept a new creative commission.
11.5 参考图表达方向，不承诺复制他人脸型、身材、天气、地点或一模一样的成片。工作室必须合理努力达到双方明确约定的风格，不能用“艺术自由”拒绝履行已确认要求。不同屏幕的正常显示差异不当然证明文件错误。
References express direction, not a promise to copy another person’s face/body, weather, location or exact image. The Studio must reasonably pursue the expressly agreed style and cannot use “artistic discretion” to ignore accepted instructions. Ordinary display differences alone do not establish file defects.
12. 服务承诺、不满意与实质问题 | Service commitment, dissatisfaction and material issues
12.1 工作室承诺拍前确认重点、现场合理预览沟通和交付后按第 11 条调整；不使用“百分百满意”“修到满意”或“不满意无条件退款”作为包车套餐承诺。客户现场表达喜欢或付款，不等于放弃后来发现的真实问题。
The Studio commits to pre-session priorities, reasonable on-site previews/communication and section 11 revisions. Photo days are not promises of “100% satisfaction”, “edit until satisfied” or unconditional dissatisfaction refunds. On-site approval or payment does not waive genuine later-discovered issues.
12.2 已按约完成时，仅因主观审美、事后改变偏好、社媒反馈不足或不再需要照片，不产生包车退款、自动免尾款或免费补拍。人像尚未购买收藏时仍可依第 4 条不购买。不得把正常具体反馈称为吹毛求疵而拒绝合理处理。
Where performance conforms, subjective taste, changed preferences, disappointing social engagement or no longer wanting images do not trigger a photo-day refund, waived balance or free reshoot. An unpurchased portrait collection may still be declined under section 4. Normal specific feedback must not be dismissed as nitpicking.
12.3 缺少已承诺核心服务、因工作室原因严重糊片、文件丢失、交付不足或明显违背确认标准，属于需认真处理的问题。先修复、补交或经客户同意安排合适补拍；不能适当补救时按实际受影响价值减价或退款。不可重复的旅行不能强迫客户再来温哥华才获救济。
Missing promised core service, serious Studio-caused technical failures, lost files, deficient delivery or clear departure from agreed standards require proper remedies. Repair, completion or a suitable consensual reshoot is offered first where appropriate; otherwise the affected value is reduced or refunded. A visitor cannot be forced to return to Vancouver to obtain a remedy.
12.4 部分问题不自动使整个包车服务免费；但摄影为本次核心目的且全部失败时，也不能只退任意一张照片单价了事。退款依实际影响、不可替代程度、可用成果、双方责任及法律要求决定，必要时可能涉及全部费用。补救不得捆绑好评、删差评或新的宣传授权。
A partial problem does not automatically make the entire photo day free. Conversely, complete failure of photography central to the booking cannot be resolved by an arbitrary single-image refund. Remedy reflects actual impact, irreplaceability, usable results, responsibility and law, potentially including the entire fee. No remedy is conditional on praise, removal of a review or new publicity permission.
12.5 客户可提交订单号、照片编号、问题及期望解决方式。工作室通常于 2 个工作日内确认收到、5 个工作日内提供实质回应；复杂事项说明原因和下一次更新时间。此内部处理不是向律师、监管者、支付机构、仲裁庭或法院求助的前提，也不暂停法定期限。
Clients may provide a booking ID, image numbers, issue and desired remedy. The Studio normally acknowledges within 2 business days and responds substantively within 5, explaining complex cases and the next update. This internal process is not a prerequisite to seeking a lawyer, regulator, payment provider, tribunal or court and does not suspend legal deadlines.
12.6 同一损失不得重复回收。在法律允许范围内，已经针对该项损失实际提供的合理补时、修复、减价或退款，应在同项后续赔偿中合理计入；不得用与另一独立损失无关的补救抵销责任，也不得借此减少依法不可削减的退款或其他救济。
12.6 There is no double recovery for the same loss. Where lawful, appropriate restored time, repair, reduction or refund actually given for that loss is taken into account in later compensation for it. Relief unrelated to a separate loss does not erase that responsibility or reduce a non-reducible statutory refund or remedy.
13. 版权、使用许可与公开展示 | Copyright, use licence and publicity
13.1 工作室保留其依法享有的版权，并确保拥有向客户授予下述许可的充分权利；本协议不是所有照片版权的买断或转让。双方依法不能排除的使用权不受限制。
The Studio retains copyright it lawfully owns and ensures sufficient rights to grant the licence below. This is not an assignment or buyout of all image copyright. Non-excludable lawful uses remain unaffected.
13.2 已付清对应影像款项后，客户取得永久、非独占的个人使用许可，可下载、私人打印、在自己的社媒和个人网站发布，用于个人职业档案及模特／演员申请。不得向图库出售、转售版权或替第三方品牌制作付费广告，除非另有书面许可。工作室署名欢迎但不是交付条件。
After the corresponding image charges are paid, the Client receives a perpetual, nonexclusive licence for downloading, private prints, personal social media/websites, professional profiles and model/actor applications. Stock sale, copyright resale or paid advertising for a third-party brand requires separate written permission. Credit is appreciated but not a delivery condition.
13.3 正常裁切、尺寸调整和平台压缩可进行。明显经过客户再编辑的版本，不应虚假归因为工作室原始处理。水印预览仅供选片评估，未购预览不得去水印冒充已购成片；本条不禁止依法使用材料维权、向专业人士举证或发表合法评价。
Normal crops, resizing and platform compression are permitted. Material client re-edits should not be falsely attributed to the Studio’s original treatment. Unpurchased proofs are for evaluation and must not have watermarks removed to pass as purchased files. This does not restrict lawful evidence, professional advice, rights enforcement or reviews.
13.4 所有套餐默认不公开。签服务协议、付款、购买 C$99 或不买照片，均不构成官网、社媒、广告或幕后宣传许可。仅在每位相关被摄者另行自愿签署独立授权、批准具体素材及用途期限后，在授权范围内使用；拒绝或撤回宣传授权不增加套餐价格、不减少已购交付。
Every package is private by default. Signing, paying, choosing C$99 or declining images is not permission for website, social, advertising or behind-the-scenes publicity. Use requires each relevant subject’s separate voluntary permission for identified material, purposes and period. Declining or withdrawing publicity permission does not increase package prices or reduce purchased delivery.
13.5 客户自行发图、@工作室或写评价，不当然授权工作室转发肖像或将评价用于广告；转发或广告使用另行征询。每名可识别成人应分别授权；监护人只能在其依法有权的范围内代表未成年人。
A client posting, tagging the Studio or reviewing it does not automatically authorize portrait reposting or advertising use of a review; permission is sought separately. Each identifiable adult consents individually; a guardian acts only within lawful authority for a minor.
14. 服务数据、AI、保留与隐私 | Service data, AI, retention and privacy
14.1 为履行预约、摄影、美妆安排、收款和交付，工作室仅合理使用必要的联系方式、日程、照片、选片、付款和相关安排信息，并采取访问控制和合理安全措施。无关敏感信息不要求提供。隐私联系人见确认表。
For booking, photography, beauty arrangements, payment and delivery, the Studio reasonably uses necessary contact, scheduling, image, selection, payment and relevant practical information with access controls and reasonable safeguards. Unrelated sensitive data is not required. The privacy contact is in the schedule.
14.2 电子签约、支付、云端交付、外部修图或 AI 处理供应商及可能的境外处理，在数据处理附表预先披露其用途、类别与实际供应商；不能只写“一切第三方均获授权”。工作室须核实供应商设置和合同，不把未验证的本地处理、保密或删除能力写成事实。
E-signature, payment, cloud-delivery, outside editing and AI processors, including possible foreign processing, are disclosed in the processing schedule by purpose, data category and actual provider. A blanket “all third parties authorized” is insufficient. The Studio verifies settings/contracts rather than asserting unverified local processing, confidentiality or deletion capabilities.
14.3 照片不得用于出售数据、广告画像、通用 AI 模型训练或建立识别客户身份的人脸数据库，除非另行取得合法、明确且自愿的授权。一般修图辅助也须与已披露目的和客户要求一致。必要处理的实际选择与合理替代须说明，不与宣传授权混为一谈。
Images are not used for data sales, advertising profiles, general AI-model training or an identity-recognition face database without separate lawful, explicit, voluntary authorization. Editing assistance must fit disclosed purposes and Client instructions. Actual processing choices and reasonable alternatives are explained separately from publicity consent.
14.4 普通已完成订单的原始及工作文件保留至拍摄后 180 日；最终已交付 JPEG 保留至相应交付后 12 个月，不承诺永久保管。尚未完成的已付交付、争议、法律保全及法定保留要求优先；第 10.5 条待选订单仅保留履约所必要的文件和记录，并定期复核。依法用于作出直接影响个人决定的信息，须自使用后至少保留 1 年；这不表示所有 RAW 均须统一保留 1 年。
For ordinarily completed orders, raw/working files remain until 180 days after shooting and delivered final JPEGs until 12 months after their delivery, without perpetual storage. Outstanding paid delivery, disputes, legal holds and statutory retention override routine deletion. A section 10.5 pending order retains only necessary performance files/records with periodic review. Information used for a decision directly affecting an individual is retained for at least 1 year after use as legally required; that is not a blanket one-year rule for all RAW files.
14.5 工作室保留必要合同、交易、授权及争议记录至合法合理期限，期限届满安全删除或匿名化；不为“将来可能宣传”无限保留照片。客户自行下载备份；发现损坏或安全事件时工作室及时控制影响，并按适用要求及事件实际情况通知。
Necessary contract, transaction, consent and dispute records remain for lawful, reasonable periods and are then securely deleted or de-identified. Images are not kept indefinitely for hypothetical marketing. Clients download backups. The Studio promptly contains known corruption/security incidents and provides notices appropriate to law and circumstances.
14.6 客户可联系隐私负责人申请依法访问、更正、撤回同意或删除；工作室说明适用保留义务、技术限制及对未完成服务的实际影响。不能保证删除第三方已经独立取得的公开副本，但自身可控制的使用须按法律和授权处理。
Clients may request lawful access, correction, withdrawal or deletion from the privacy officer. The Studio explains applicable retention duties, technical limits and actual effects on unfinished services. Independently acquired third-party public copies cannot be guaranteed deleted; Studio-controlled uses remain subject to law and consent.
15. 责任边界与不可排除责任 | Liability boundaries and non-excludable duties
15.1 工作室以合理技能、注意和勤勉履行服务。设备、天气和人的表现可能变化，但本协议不免除合理备份、规划、卫生或安全责任，也不把客户签字当成一般性免责。
The Studio performs with reasonable skill, care and diligence. Equipment, weather and human expression may vary, but the agreement does not excuse reasonable backup, planning, hygiene or safety duties or treat a signature as a general release.
15.2 【纯经济损害赔偿上限】在法律允许范围内，工作室因普通合同违约或普通疏忽产生的纯经济损害赔偿，针对同一次受影响预约累计不超过该预约已明确购买的含税合同总价，包括双方明确接受的补充订单，但不包括未购买的升级、假设加时或由客户直接另订的第三方交易。本上限只限制损害赔偿，不削减本协议明确约定的履行、退款、减价义务或依法不得排除／限制的救济。
[Economic-damages cap] To the extent lawful, aggregate damages for purely economic loss caused by ordinary contractual breach or ordinary negligence are capped per affected booking at its expressly purchased tax-inclusive contract price, including accepted supplemental orders but excluding unpurchased upgrades, hypothetical overtime and third-party contracts separately purchased directly by the Client. This caps damages, not express obligations to perform, refund or reduce price, or remedies that cannot lawfully be excluded or limited.
该上限不适用于欺诈、故意不当行为、重大过失、死亡或人身伤害、运输事故责任、隐私或保密义务违反，以及任何不得限制的法定责任。退款与赔偿间的同项损失抵扣依第 12.6 条处理。本条不是“所有情况下最多只退套餐款”，也不是保险或一般免责书。
The cap does not apply to fraud, intentional misconduct, gross negligence, death/personal injury, transport-accident liability, privacy/confidentiality breaches or non-limitable statutory duties. Section 12.6 governs credits for the same loss between refunds and damages. This is not an all-circumstances package-price limit, insurance or a general release.
15.3 不保证涨粉、商业收入、参赛名次或第三方认可。工作室对其团队和受托服务范围内的人员负责，不能仅因使用外包就把已承诺服务的责任转给客户。不得要求客户为工作室自身过错作无限赔偿或免责。
There is no guarantee of followers, income, competition placement or third-party approval. The Studio remains responsible for its team and delegated promised services and cannot shift that responsibility to the Client merely by outsourcing. No unlimited Client indemnity or release for Studio fault is required.
16. 法定权利、争议与合同一致性 | Statutory rights, disputes and consistency
16.1 适用 BC 法律及加拿大适用联邦法律，其他依法不可排除的消费者保护仍保留。任何七天偏好修改窗口、定金、取消费、责任上限或订单完成表述，均不得排除或限制依法不可排除或限制的取消、退款、隐私、赔偿及其他权利。第 15.2 条仅在法律允许的范围内适用。
BC law and applicable federal Canadian law govern, preserving other mandatory consumer protection. No seven-day preference window, deposit, cancellation charge, cap or completion statement excludes or limits cancellation, refund, privacy, damages or other rights that cannot lawfully be excluded or limited. Section 15.2 operates only within what the law permits.
16.2 消费者合同可能同时适用远程销售和未来履行规则，依法有冲突时适用对消费者更有利的规定。必要内容缺失、事前披露不符或遗漏、未按期提供合同副本及逾期未供给等，可能产生法定取消／退款权；并非一律仅限七天，也不是普遍一年无理由退款。客户可用能证明时间和内容的方式通知并说明适用原因，不必先走内部投诉。第 9 条取消费及第三方扣除不覆盖依法要求无扣减退款的情况，法定退款按法定起算日及期限处理。
Distance-sales and future-performance rules may overlap; where the law provides, a conflict is resolved in the consumer’s favour. Missing required content, omitted/inconsistent advance disclosure, late contract copies or non-supply may create statutory cancellation/refund rights. These are not universally limited to seven days and are not a general one-year change-of-mind entitlement. Provable notice stating an applicable reason need not await internal complaints. Section 9 charges and third-party deductions do not override a statutory deduction-free refund; statutory triggers and deadlines govern.
16.3 不限制客户发表合法评价、不要求删差评，不预先强制仲裁、调解或放弃集体诉讼。争议发生后双方可自愿选择协商或其他方式；任何一方可向有管辖权的监管机构、法庭或法院寻求救济。
Lawful reviews are not restricted or required to be removed. There is no advance mandatory arbitration/mediation or class-action waiver. After a dispute arises the parties may voluntarily choose negotiation or another process; either may seek a competent regulator, tribunal or court.
16.4 本协议中英文为同一交易的对应文本，均向客户提供；核心金额和期限应一致，不设隐藏的单方英文优先免责。发现差异时共同核实已明确承诺的内容，在确认前不得用歧义扩大客户付款或宣传授权，亦不排除法院解释权。
Chinese and English are corresponding texts of the same transaction and both are supplied. Material amounts and deadlines must match; there is no hidden English-priority disclaimer. Discrepancies are reconciled against express commitments, without using ambiguity to expand payment or publicity permission, and without restricting judicial interpretation.
16.5 预约确认表中明确的特别约定、之后双方明确接受的变更及本条款共同构成合同，但不借“完整协议”否认工作室先前可依法约束的宣传或承诺。网站日后更新不追溯修改已成立订单。无效条款仅在合法范围内分离，其他条款继续适用。
The schedule, expressly accepted later amendments and these terms form the agreement, without an entire-agreement clause erasing legally binding prior representations. Later website changes do not retroactively amend a booking. Invalid provisions are severed only to the extent lawful, with the remainder continuing.
16.6 不自动续订，不要求未来购买，不存在贷款、担保或抵押安排。本协议未约定以介绍新客户或后续成交作为本单优惠、退款或履约条件；任何活动另经合法审核并明示。
There is no automatic renewal, future purchase obligation, loan, guarantee or security interest. This agreement does not make a discount, refund or performance conditional on referring new clients or a later sale. Any separate promotion requires legal review and clear disclosure.
